Purpose of processing your personal data:

The purpose of the processing will be to manage the request made through the website, whether via a contact form or any other type of online form, or through a request by e-mail. Such a request may be, but is not limited to, the handling of a request, the reply to a request for commercial information, the application for employment or, where appropriate, the subscription to company newsletters, as well as any other interaction between the user of the website and COM 2002, S.L.U. (Nexica), who deals with the needs of the user, whether a customer, potential customer, supplier or candidate. All the requested data is necessary to be able to deal with the request.

Likewise, the data provided will also be used to send you commercial information about our products and services that may be of interest to you by post, e-mail, SMS or any other equivalent electronic means of communication. In the event that users do not wish to receive commercial communications, they will have the opportunity to refuse receipt of such communications by not ticking the corresponding box on the information or contact form itself, or even by exercising their right of opposition at the abovementioned address.

Legitimacy for the processing of your data

The lawful basis for the processing of your data is the execution of the business relationship to which you are a party, so that we can manage, develop and control the corresponding commercial and contractual relationship. All the data that we request from you is obligatory and, therefore, failure to supply any part of it may make it impossible to provide the services that we offer through our website.

Regarding the sending of commercial communications by electronic means – as a result of a prior contractual relationship - the lawful basis is the legitimate interest of COM 2002, S.L.U., by virtue of Article 21.2 of the Law on Information Society Services.

Regarding the sending of commercial communications by any means, including electronic communications - outside of any contractual relationship, but based on a legitimate interest since you are contacting the entity - the lawful basis is the consent requested at the time and which you freely give. If we do not obtain your consent, COM 2002, S.L.U. undertakes not to process your data for advertising purposes.

COM 2002, S.L.U. may communicate your personal data to any public administration with competence in the matter and in the event that there is a legal obligation to do so.

In the case of CV management, the data may have to be communicated to any customers involved in the recruitment process.

However, if at any point in the commercial relationship it is necessary to communicate your data to third parties for new purposes, such communication will be made when COM 2002, S.L.U. has your prior consent to do so and in the legally required manner.

There may also be third parties who, as a result of services provided to COM 2002, S.L.U., may access your personal data.

 

Rights:

Anyone has the right to obtain confirmation as to whether we are processing personal data concerning them at COM 2002, S.L.U. and, if so, the right to access their personal data, for processing purposes, and the categories of personal data concerned.

You shall also have the right to request the rectification of inaccurate data or, where appropriate, to request its deletion, where the data is no longer necessary for the purposes for which it was collected; where you have withdrawn the consent on which the processing is based or you object to the processing; where personal data has been processed unlawfully; or where it must be deleted in order to comply with a legal obligation laid down in European Union or Member State law.

In such cases, we will only retain data for the exercise or defence of claims.

In certain circumstances and for reasons related to your particular situation, you may object to the processing of your data. COM 2002, S.L.U. will cease to process the data, except for overriding legitimate reasons, or the exercise or defence of possible claims.

You shall have the right to receive the personal data concerning you, and which you have provided, in a structured format, and to transfer it to another controller without being prevented by the data controller to whom you have supplied it, where processing is based on consent; or where processing is carried out by automated means.

When the persons concerned exercise their rights of access, rectification, deletion and opposition, limitation of processing, data portability and not to be the subject of individualised automated decisions, they must notify us by e-mail at the address rgpd@nexica.com

Finally, under the terms established in the legislation in force, they may revoke the consents they have given us, with the data subject having the possibility of submitting a complaint to the Spanish Data Protection Agency.

 

Origin

Any personal data we process at COM 2002, S.L.U. comes from the person concerned.

Users give their assurance and are responsible, in all cases, for the truthfulness, accuracy, validity and authenticity of any Personal Data provided, and undertake to keep it duly updated. Users also give assurance that they are over 14 years of age.

In the event where personal data is provided by persons other than the owners of such data, the user must, prior to its inclusion, inform such persons of the information contained in the preceding paragraphs.
