These General Conditions of Use and Hiring (hereinafter “the General Conditions”) govern, together with the Privacy policy, access to and the use of, by the user, of the www.nexica.com website (hereinafter “the Website”), as well as the hiring of products and services through it. By accepting these General Conditions, the User states:
The use of the Website attributes the condition of Website User (hereinafter the “User”) and entails acceptance of all the terms included in these General Conditions. The User should read these General Conditions carefully every time they access the Website, as the latter and the General Conditions may have changed.
The owner of the Website reserves the right to make, at any time and without the need for notice, any modification or update of its contents and services it deems necessary; of these General Conditions and in general any elements comprised in the design and configuration of the Website.
The modification of these General Conditions will not affect any goods or promotions acquired before the modification.
In compliance with the provisions of article 10 of Law 34/2002, of 11 July, on the Information Society and E-Commerce (hereinafter “LSSICE”), general information is offered below on the Website:

2.1. Access to the Web site
Access to the Web site is free, except for any charges pertaining to cost of connection through the telecommunications network supplied by the User's ISP.
2.3. Registration requirement
As a rule, no registration is required to access the services and contents of the Website. Nevertheless, the use of certain services and contents may be conditioned to prior registration by the User.
The data entered by the User must be exact, up to date and true at all times. The registered User will be responsible at all times for the safekeeping of their password, consequently assuming any damages that may be caused through undue use, as well as from the transfer, disclosure or loss thereof. To this end, access to restricted areas and/or the use of the services and contents using the password of a registered User will be assumed to have been made by the registered User, who will be responsible, in any event, for any such access and use.
2.4. Rules for use of the Website
The User undertakes to use the Website and all its contents and services in accordance with the provisions of the law, morality, public order and these General Conditions. Similarly, they undertake to make suitable use of the services and/or contents of the Website and not to use them for illegal activities or any which constitute an offence, infringe third-party rights and/or infringe the regulations on intellectual and industrial property or any other procedures of the applicable law.
The user undertakes not to transmit, introduce, disseminate and make available to third parties any type of material and information (data, contents, messages, drawings, sound and image files, photographs, software, etc.) that contravene the law, morality, public order and these General Conditions. By way of example, which is not exhaustive, the User undertakes to:
I.- Refrain from introducing racist, xenophobic or pornographic contents or propaganda, supporting terrorism or violating human rights.
II.- Refrain from introducing or disseminating, through the network, data programmes (virus and malware) that might cause damages to the computing systems of the access provider, its suppliers or third party Internet users.
III.- To refrain from disseminating, transmitting or making available to third parties any type of information, element or content that infringes the basic rights and public freedoms acknowledged in the constitution and in international treaties.
IV.- To refrain from disseminating, transmitting or making available to third parties any type of information, element or content that constitutes illegal, unfair or misleading advertising.
V.- To refrain from transmitting unrequested or unauthorised material, spam, chainmail, pyramid structures or any other form of solicitation, except in areas (such as commercial spaces) exclusively conceived for this purpose.
VI.- To refrain from introducing or disseminating false, ambiguous or inexact information and contents that induce an error in the receivers of the information.
VII.- To refrain from stealing the identity of other users using their passwords for access to the different services and/or contents of the Website.
VIII.- To refrain from disseminating, transmitting or making available to third parties any type of information, element or content that entails an infringement of the intellectual and industrial property rights, patents, trademarks or copyright corresponding to the owner of the Website or to third parties.
IX.- To refrain from disseminating, transmitting or making available to third parties any type of information, element or content that entails an infringement of the secrecy of communications and personal data legislation.
The User undertakes to keep NEXICA free from any possible claim, fine, penalty or sanction it may be obliged to bear as a result of non-fulfilment by the User of any of the aforementioned usage procedures, with NEXICA likewise reserving the right to claim for any corresponding damages.
2.5. Exclusion of Responsibility
NEXICA accepts no responsibility with regard to updating this Website to keep the information updated and does not guarantee that the information published is precise or complete. Therefore, the User should confirm that the information published is precise and comprehensive before taking any decision related to any service or contents described on this Website.
Access by the User to the Website does not mean that NEXICA is obliged to monitor the absence of virus, worms or any other harmful computing element. In any event, the user is responsible for having suitable tools for the detection and disinfection of harmful computer programmes.
NEXICA cannot be held responsible for damages to Users' software and computing equipment during the use of the services offered on the Website.
NEXICA cannot be held responsible for damages of any kind caused to the User by faults or disconnections in the telecommunication networks that lead to the suspension, cancellation or interruption of the Website service during the provision thereof or before it.
2.6. Links to other contents and services through the Website
The Web site access service includes technical link devices, directories and even search instruments that allow the user to access other Internet pages and portals (hereinafter “Linked Sites”). In such cases, NEXICA will only be responsible for the contents and services provided in the Linked Sites to such an extent that it knows that they are illegal and has not deactivated the link with due diligence. If the User considers that there is a Linked Site with illegal or unsuitable contents it may inform NEXICA, without any such communication entailing an obligation to withdraw the corresponding link.
In no case does the existence of Linked Sites presuppose the formalisation of agreements with the people in charge of them or their owners, nor that NEXICA recommends, promotes or identified with the contents or services provided.
NEXICA is not aware of the contents and services of the Linked Sites and, therefore is not responsible for the damages caused by the illegality, quality, failure to update, non-availability, error and uselessness of the contents and/or services of the Linked Sites or for any other damage that is not directly ascribable to NEXICA.
2.7. Intellectual and industrial property
All the contents of the Website, understood to be, by way of example only, texts, photographs, graphics, images, icons, technology, software, links and other audiovisual or sound contents, as well as their graphic design and source code, are the intellectual property of NEXICA or of third parties, without any of the operating rights to them acknowledged by the applicable legislation in matters of intellectual property being understood to be transferred to the User.
The brands, trademarks or logotypes are owned by NEXICA or third parties, without it being understood that access to the Web gives them any right to them.
2.8. Personal data protection
NEXICA declares that it complies with the applicable legislation on Data Protection, particularly with the Organic Law 15/1999, of December 13, on Data Protection, as well as with Royal Decree 1720/2007 of December 21, approving the regulation developing the Constitutional Law 15/1999, of December 13, on personal data protection.
The User STATES that all the information provided to NEXICA is true, complete and precise, and in accordance with The Organic Law on Data Protection, any person that buys any of the products or services offered through the NEXICA web site expressly authorises COM 2002, S.L. to add to an automated file the personal data provided on the forms that are indispensable to render the services requested.
The trading organisation COM 2002, S.L. is responsible for the file and for the purpose of use of the right of access, cancellation, correction or opposition provided for in 15/1999, on personal data protection, the following address is made available to all clients: COM 2002, S.L., with registered offices in C/Acer 30-32, 1º 4ª; 08038 - Barcelona, as well as the following e-mail address: lopd@nexica.com.
The sending of data by the user through the NEXICA Web or any information sent by the latter is protected by the technical and organisational measures required depending on the level of security applicable to the data in question. Similarly, data supplied and stored in our data bases are also protected by safety systems that prevent unauthorised third-party access.
NEXICA will make every effort to have updated systems to ensure the greatest possible efficacy of these security systems.
2.9. Nullity and inefficacy of the clauses
If any clause included in these General Conditions were declared total or partially null or inefficacious, this would only affect the provision or part declared null or inefficacious, with the remaining clauses of these General Conditions remaining fully in force, and only the part that is declared totally or partially null or inefficacious will be deemed not included.
2.10. Applicable legislation and jurisdiction
These General Conditions will be governed and constructed according to Spanish Law, unless expressly established otherwise. NEXICA and the User agree to bring any controversy that may arise from the provision of the products or services which are the object of these General Conditions to the Courts of Law of the User's jurisdiction.
Pursuant to the provisions of Organic Law 15/1999, of December 13, on Personal Data Protection (hereinafter, “LOPD”), the User is informed that all personal data they provide through the Website www.nexica.com (hereinafter, “the Website”) will be added to and processed in the files belonging to COM 2002, S.L. (hereinafter “NEXICA”) for the following purposes: to provide the services requested by the User; to keep the User informed, even by electronic media, about NEXICA products and services; to activate the sending of the NEXICA newsletter and carry out market and opinion studies.
Completion of all the data requested through the Website is necessary for the optimal rendering of the services made available to the User. If all the data are not provided, NEXICA does not guarantee that the information and services rendered will be provided properly or will meet the User's needs.
The User may exercise their right of access, correction, cancellation and challenge provided for in the LOPD by means of written communication addressed to COM 2002, S.L.; C/Acer, 30-32, 1º 4ª; 08038 – Barcelona; or else by e-mail to lopd@nexica.com. In both cases, the interested User must attach copy of their National Identity Card, passport or other valid document that identifies them.
The User, by checking the box that appears in the Legal Notice, expressly accepts, freely and unequivocally, for their personal data to be processed by NEXICA for the following purposes:
- Sending of commercial communications by e-mail, fax, SMS, MMS, social networks or any other electronic or physical medium, present or future, that permits commercial communications.
Before providing personal data on third parties on the Website, the User must secure their prior and express consent, having informed them of the terms of this Privacy policy. The User undertakes to keep NEXICA free from any possible claim, fine, penalty or sanction it may be obliged to bear as a result of non-fulfilment by the User of any of the aforementioned obligation.
In the rendering of the service requested, the User expressly accepts that NEXICA may subcontract such services to other organisations. In any case, NEXICA guarantees that the companies subcontracted will be located in countries with a level of data protection similar to Spain, and with whom it will have signed a contract pursuant to article 12 of the LOPD.
NEXICA, on its own Account or on account of a third party contracted to render measurement services, may use cookies when the User browses the Website. Cookies are files sent to the browser by means by means of a web server to record the User's activities while browsing.
The cookies used by the Website are associated only with an anonymous user and their computer, whereby they provide no personal data on the User.
By using cookies the server hosting the Website can recognise the Web browser used by the User, to make browsing simpler, permitting, for example, access to users who have already registered access to areas, services, promotions or offers reserved exclusively for them without having to register at each visit. They are also used to measure audience and traffic parameters and monitor progress and the number of entries.

To use the Website the User does not need to permit the installation of the cookies sent by the Website or the third party acting on behalf of NEXICA, without prejudice to the User having to start a session as such in each one of the services that require prior registration or login.
